Terms of Service

3.1 Who Can Use Studio

• You must be at least 18 years old. You confirm this when you sign up.
• One person per account. Do not share, sell or transfer your account.
• Studio may not be available in every country.

3.2 Signing In

You sign in with a link sent to your email or with your Google account. Studio has no passwords. To keep your account safe:

• Keep your email inbox and Google account secure. Anyone who can open your sign-in emails can get into your account
• Keep your email address accurate and up to date
• Do not forward or share sign-in links
• Tell us at support@gncy.ai right away if you think someone else has used your account

You are responsible for all activity under your account.

3.3 One AIGNCY Account

Your Studio sign-in is an AIGNCY account. The same account can sign in to other AIGNCY apps that share it. These Terms cover your use of Studio.

3.4 Free Trial

• New accounts get a one-time free trial of 5,000 credits. Trial credits expire 14 days after they are added.
• One trial per person. We may refuse or remove a trial when we see repeat or automated sign-ups.
• Trial credits cannot be turned into purchased credits.

3.5 Accounts From the Old Studio

If you used the old AIGNCY Studio, you can claim your old account for 90 days by signing in with the same verified email address. We then move your content, AI models and credit balance to your new account.

• Old passwords are not carried over. Sign in with an email link or Google.
• Purchased credits move across and still never expire. Unexpired plan and trial credits keep their old expiry date.
• Accounts that were deleted in the old Studio are not moved.
• Old accounts whose email address was never verified are not linked automatically.

4.1 Plans

Plans are billed monthly or yearly and add credits every month. Each plan's price, monthly credits and features are shown in Plans and credits before you pay. Yearly plans add their credits monthly, not all at once.

4.2 Billing

• Plans are billed in advance, monthly or yearly
• Payment is processed through our third-party payment processor (Stripe)
• Tax is added at checkout where the law requires it
• Prices are subject to change with 30 days' notice
• If a payment fails, we will tell you and ask you to update your card. No new plan credits are added until the payment goes through

4.3 Credits

Credits pay for generations, AI models and shop items. Your balance can hold different kinds of credits, and each kind has its own expiry:

• Trial credits: expire 14 days after they are added
• Plan credits: expire at the end of the monthly period they were added for, on monthly and yearly plans alike. Unused plan credits do not roll over
• Purchased credits (credit packs): never expire
• Reward credits (for example from challenges or referrals): any expiry is shown in your credit activity when they are added

Studio spends the credits that expire soonest first, so purchased credits are used last. Credits have no cash value. They cannot be sold, transferred to another account or exchanged for money.

4.4 Credit Prices and Automatic Refunds

• We reserve the right to adjust credit costs for specific features. The credit price is always shown before you confirm a generation, an AI model or a purchase, and that is the price you are charged.
• If a generation fails, its credits come back to your balance automatically. The same applies to an AI model that fails to build.
• Refunded credits go back to the kind of credit they were spent from, with the same expiry.
• If you cancel a job that is still waiting in your queue, you get all its credits back. Once a job has started generating, cancelling it does not refund its credits.

4.5 Changing Your Plan

• Upgrades start right away. You pay the difference for the rest of the current period and get the extra monthly credits straight away.
• Downgrades start at the end of the current period. Nothing is taken away before then.
• Switching between monthly and yearly billing follows the same rules.

4.6 Cancelling Your Plan

• You can cancel at any time in Account › Plans and credits › Cancel plan
• Your plan stays active until the end of the period you have paid for, then stops renewing. You will not be charged again
• Plan credits you already have stay usable until they expire at the end of that period. On a yearly plan, monthly credits keep arriving until the end date
• Purchased credits, your AI models and your Vault stay in your account
• You can use Resume plan at any time before the end date

5.1 What the Shop Sells

The shop sells AI models, content packs and bundles. Exclusive AI models, launch kits and content packs are priced and paid in US dollars and are also governed by the Shop Terms; other items are priced in credits. Ready-made AI models in the shop are fully synthetic, or based on a real creator who has signed an AI likeness consent.

• Items are delivered to your account straight away and appear in your collection.
• Buying an item lets you use it in Studio on your own account. It does not transfer ownership of the item itself.
• Shop items cannot be resold, traded, gifted, moved to another account or exchanged for money.
• If you delete a shop AI model, you may not be able to get it back.
• Limited editions and countdowns apply only to items sold directly, never to crates.

5.2 Crates

Crates are not on sale at the moment. If we offer them, these rules apply. A crate gives you one random item from a list. Before you buy, the crate shows every item it can contain and the exact odds of each one.

• Odds are the same for everyone and for every open. Earlier opens never change them. There is no pity timer and no guarantee.
• Every item in a crate is also sold on its own at a listed price.
• If you already own the item you get, it turns into credits at its shop price, up to what you paid for the crate.
• You must be 18 or older to buy a crate, and you confirm this before you buy.
• A monthly crate spending limit applies. It resets on the 1st of each month.
• Paid crates are not available in some places, currently Belgium, the Netherlands, South Korea and the US state of Washington.
• A crate is opened as soon as you buy it, so it cannot be cancelled afterwards.
• Crate items have no cash value and cannot be traded, gifted, sold or cashed out.
• We log every crate open. Your pull history shows yours.
• Free daily rewards are separate from paid crates.

8.1 Your Generated Content

• As between you and AIGNCY, you own the content you generate and may use it for any lawful purpose, including commercial use
• We claim no rights in your generated content beyond what we need to store it, show it to you and run the Service
• Results can include elements of our templates and shop items. Those stay ours or our licensors', and you may use them only as part of your generated content

8.2 Labelling AI Content

Content made with Studio is AI-generated. When you post it, you are responsible for labelling it as each platform's rules and the law require. Instagram and TikTok, for example, ask for AI-generated content to be labelled. The Calendar reminds you, but the choice and the responsibility are yours.

• Do not present AI content as a real photo or recording of a real person or event in a way that misleads people
• Do not use Studio, including CLEAN-1, to remove or hide an AI label that a law or platform rule requires

Studio does not currently add a visible watermark or AI label to your files.

9.1 Content Rules

Studio is for safe-for-work content. You may NOT make, upload or share:

• Content depicting minors (under 18) in any context
• Sexually explicit content or nudity
• Intimate images of a real person shared without their consent, including AI-made ones
• Content that uses a real person's face or body without their consent
• Content that harasses, threatens, defames or impersonates anyone
• Content that infringes someone else's copyright, trademark or other rights
• Content that violates applicable laws

9.2 Using the Service Fairly

You may NOT:

• Try to get around safety filters, for example by splitting a request into steps
• Create extra accounts to get more free trials or rewards
• Share your account or sign-in links with others
• Use the Service for illegal purposes
• Attempt to reverse-engineer or copy our technology
• Resell or redistribute templates, prompts or shop items, or resell generated content as templates
• Use bots, scrapers or other automated tools to abuse the Service

10.1 Reporting Content

If content on Studio shows you, or someone you are allowed to act for, without consent, send a request with the takedown form. We review every request and remove content covered by a valid request within 48 hours of receiving it. We reply to the email address on the request.

10.2 Content Moderation

We do not review every upload or result before it is made. Our AI providers keep their own protections against content involving minors, and we act on reports. We reserve the right to:

• Review content that is reported to us, or that we have reason to believe violates these Terms
• Remove content, AI models or templates that violate these Terms
• Limit, suspend or close accounts that violate these Terms
• Report illegal activity to authorities

11.1 Your Content

• You retain ownership of content you upload
• You grant us a license to process, store, and display your content to provide the Service
• You represent that you have all necessary rights to uploaded content

11.2 Our Property

• The Service, including software, algorithms, design, templates, prompts and shop items, is owned by AIGNCY or its licensors
• You may not copy, modify, or create derivative works, except as these Terms allow

11.3 Other People's Content

Inspo shows public posts from other creators for ideas. They belong to their owners.

13.1 Service Availability

• The Service is provided "as is" without warranties
• We do not guarantee uninterrupted or error-free service
• We may suspend service for maintenance or updates

13.2 AI Accuracy

• AI-generated content may contain errors or artifacts, and an AI model's likeness can vary between results
• We do not guarantee the quality or accuracy of outputs
• Generated content may not be suitable for all purposes. Check each result before you use it

13.3 Limitation of Liability

To the maximum extent permitted by law:

• AIGNCY is not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the 12 months prior to the claim
• We are not liable for content you generate or how you use it

16.1 By You

You can delete your account at any time in Account settings. Deleting it removes everything right away and cannot be undone:

• Your profile, email and sign-in methods
• Every AI model you made, including all its face and body photos
• Everything in your Vault: photos, carousels, reels, uploads and folders
• Your credits, including purchased credits
• Your plan, which is cancelled so you are not charged again

Want a copy first? Download what you need from your Vault before you delete. A few records are kept after deletion, as the Privacy Policy explains. Cancelling your plan without deleting your account is covered in section 4.6.

16.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• Required by law

16.3 Effect of Termination

Upon termination:

• Your access to the Service ends
• Your plan is cancelled and you are not charged again

17.1 Governing Law

These Terms are governed by the laws of the State of Florida, USA.

17.2 Arbitration

Any disputes shall be resolved through binding arbitration in Pinellas County, Florida, except:

• Small claims court disputes
• Injunctive relief requests

17.3 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action.
